Terms and Conditions (User Agreement)

These Terms and Conditions (“Terms”) govern your use of the H91Pay Hindustan ATM platform, including all related mobile applications, websites, services, and interfaces operated by H91 Fintech Private Limited, a company incorporated under the Companies Act, 1956, with its registered office at 101 Platinum Plaza, 1st Floor, PU-4, Scheme No. 54, Vijay Nagar, Indore, MP, INDIA – 452010 (hereinafter referred to as “H91Pay”, “Hindustan ATM”, “we”, “our”, or “us”).By accessing or using the Platform, you agree to be bound by these Terms. Please read them carefully.

  1. Definitions
  • “We”, “Us”, “Our”, or “Company” refers to H91 Fintech Private Limited.
  • “User”, “You”, or “Your” refers to any person who accesses or uses the H91Pay Hindustan ATM or Hindustan ATM application or website.
  • “Platform” includes the mobile application, website, and any other interface offered by the Company.
  1. Acceptance of Terms

By using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not access or use our services.

These Terms must be read in conjunction with our Privacy Policy, KYC Policy, Merchant Onboarding Policy, and Dispute & Grievance Policy, all of which are incorporated herein by reference.

  1. Eligibility

You must be at least 18 years of age and legally competent to enter into a binding contract under applicable law. Use of the Platform by anyone under 18 is strictly prohibited.

  1. Changes to Services

We may update, enhance, suspend, or permanently discontinue any part of our services or features at any time without prior notice.

We are constantly evolving to provide better experiences, and you agree that the form and nature of services may change over time.

  1. Account Access and Suspension

We reserve the right to disable or suspend your access to the Platform at any time in case of suspicious activities, policy violations, legal obligations, or security concerns.

If we disable your account, you may be prevented from accessing your account, content, and other services, and you will be notified accordingly.

  1. Termination of Use

You may stop using the Platform and its services at any time. You are not required to specifically notify us when you stop using the services.

  1. User Data Retention and Deletion

We may retain your personal data and sensitive personal information (SPDI) as required by law. Users may contact the Grievance Officer if they do not wish for their data to be retained. In such cases, certain services may no longer be accessible.

We reserve the right to delete any personal information or SPDI stored in your account as per applicable policy and legal requirements.

  1. Usage Limits

We may, at our sole discretion, impose fixed upper limits on the number of transactions, data exchanges, or sessions you may send or receive through our Platform.

  1. User Responsibilities
  • You agree to use the Platform in compliance with all applicable laws and these Terms.
  • You shall not misuse or interfere with the services or attempt unauthorized access.
  1. Intellectual Property

All content, design, trademarks, and software on the Platform are owned or licensed by H91 Fintech Private Limited. Unauthorized use is strictly prohibited.

  1. No Guarantee of Continuity

We do not guarantee that the services will be available at all times or without interruption. Maintenance, upgrades, or unforeseen technical issues may affect availability.

  1. Updates to Terms

We may modify these Terms at any time. Continued use of the Platform after such modifications constitutes acceptance of the updated Terms.

  1. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with Indian laws. Any disputes arising shall be subject to the jurisdiction of courts located in Indore, Madhya Pradesh, India.
